An artist can give his permission have his MetaBirkins NFT displayed at a Swedish museum if the exhibit prominently notes a jury found it infringed Hermès International SA’s Birkins handbag trademarks, a federal judge ruled.
Mason Rothschild, who’s real name is Sonny Estival, initially failed to secure the blessing of the US District Court for the Southern District of New York to give the museum permission to display the NFT. But the court reconsidered after he secured sworn statements that it would be made clear a jury found he’d intentionally tried to deceive the public.
