EAST LONGMEADOW, Mass. (WWLP) – Five local non-profits say that the running company 4RUN3, owes them nearly $30,000.
This comes after the East Longmeadow organization, which held fundraising events, announced earlier this month, that they were closing and said they are bankrupt.
Lawyers representing the Smile Like Jack Memorial Fund, SMOC Open Pantry Services, Inc., and the Hampden County Bar Foundation, are requesting that the Bankruptcy Court enter an order on the petitioning charities’ request, that an involuntary Chapter 7 bankruptcy be entered against ‘4Run3 Racing LLC.’
In their joint statement, they said in part that the charities should not be left wondering what happened to their donations. They add that if their petition is allowed, the court will appoint a trustee to investigate what happened to their funds, and hopefully help the nonprofits recoup some of their money.
When 4RUN3 announced they were shutting down in a Facebook posting, they described themselves as financially bankrupt, but never filed any paperwork to make it official, which would have reorganized and forgiven debts that could not be paid.
4RUN3 has 21 says to respond to the filing before bankruptcy proceedings can officially start. If they fail to respond or the court rules in favor of the petitioners, an order for relief is entered and the company will be placed into official bankruptcy.
